The Civil Litigation Clinic

The Clinic for the Exercise of Human Rights through Civil Law is an innovative clinic that aims to provide tools – theoretical and practical – for promoting human rights through civil law – tort proceedings, class actions, insolvency and execution proceedings, remedies for violation of consumer rights, discrimination in standard contracts and more.

The clinic operates in administrative petitions and petitions to the High Court of Justice on issues related to economic harm and assistance to people in poverty.
The standard tools of public and criminal law do not provide a satisfactory and complete response to human rights violations, whether due to substantial limitations on the range of possible remedies, and reasons relating to procedure and evidence.
Thus, for example, the struggle to promote the right to live with dignity is expressed in petitions to the High Court of Justice claiming that the amount of the allowances granted by the state does not allow for a dignified living. At the same time, from the perspective of civil law, there is a daily legal battle in the execution offices and in the courts regarding the actual content of the right – payment orders, insolvency proceedings and more.
When the court orders the release of a person from detention because he was detained in an illegal cell, or without reasonable suspicion, his liberty is guaranteed from now on, but compensation for his damages due to the detention will be obtained through the civil process, which will serve both to compensate for the violation of liberty in the past and as an effective tool to prevent unjustified infringement of liberty in the future.
The violation of human rights may occur not only by public bodies but also by powerful private entities, such as insurance companies, banks or communications companies, reinforcing the need to provide civil protection to the “small citizen” against abuse of these power gaps.
Other topics dealt with by the clinic: representation in libel suits (silencing), exercising and promotion of the rights of the transgender population, representation of debtors in insolvency proceedings and various proceedings relating to debts, objections to settlement in class actions, representation in consumer issues, public housing, civil suits of suspects and defendants, and more.
