The book, which has been released by Cambridge University Pres pays particular attention to the law and economics aspects of environmental problems and policy. Examples are the property rights approach to environmental policy and incentives for pollution abatement generated by environmental liability. Theoretical analysis is illustrated by using practical examples like the US American "Superfund"-legislation (CERCLA) and the German environmental liability law. Moreover, international legal architectures, like the Kyoto Protocol, are analysed from an economic perspective. 11/2/10 CALL FOR APPLICATIONS for a Post-Doctoral Position: ERC PROJECT RESEARCHING CONDITIONS FOR EFFECTIVE INTERNATIONAL ADJUDICATION, http://www.effective-intl-adjudication.org/. The position is available with the ERC Project Researching Conditions for Effective International Adjudication (The Effectiveness Project). The Effectiveness project is a five year research project funded by the European Research Council. It is designed to develop and apply criteria for assessing the effectiveness of international courts and tribunals. For more information.  Led by Prof. Yuval Shany, the project is carried out by a research group based at the Faculty of Law, in the Hebrew University of Jerusalem. For the academic year 2010-2011, the project is offering one post-doctoral fellowship for researchers interested in studying international court effectiveness. The sum awarded as a fellowship will be 24,000 Euro per annum, plus the cost of one round trip to Israel (where applicable). Interested applicants are invited to submit a short letter of intent by 1 March 2010, to which a one page research project proposal, a CV, a writing sample, and a letter ofrecommendation from the PhD supervisor (confirming, inter alia, the award or submission of a PhD) should be appended. 9/2/10 CALL FOR PAPERS:  SEARLE CENTER - THIRD ANNUAL RESEARCH SYMPOSIUM ON THE ECONOMICS AND LAW OF THE ENTREPRENEUR, Northwestern School of Law, June 17th-18th, 2010.   The Searle Center on Law, Regulation, and Economic Growth is issuing a call for original research papers to be presented at the Third Annual Research Symposium on The Economics and Law of the Entrepreneur at Northwestern University School of Law. Papers for the conference should be submitted to d-gundersen@law.northwestern.edu by February 20, 2010. Authors will be notified of decisions by March 5, 2010. Authors will receive an honorarium of $1,200 per paper to cover reasonable transportation expenses. Government employees and non-US residents may be reimbursed for travel expenses up to the honorarium amount. Authors are expected to attend and participate in the full duration of the symposium. The Searle Center will make hotel reservations and pay for rooms for authors and discussants for the night of Thursday, June 17th.  The conference is organized in cooperation with the Journal of Economics & Management Strategy (JEMS), which is edited by Dan Spulber. While the central focus of the journal is the European law regulating inter alia Chemicals (REACH), Nanomaterials, Pharmaceuticals, Food and Feed, Cosmetics, Pollution, Climate Change, Industrial Accidents and Public Health, discussion extends to other social sciences, such as regulation studies, risk analysis, safety science, political science and sociology. The EJRR invites submissions for the first issues of the journal. The editors are looking for papers that communicate new research, business analysis and policy insights to an informed readership across EU regulatory domains. Now freely available for download: EALE Working Paper 014-2009: Roland Kirstein, Volkswagen vs. Porsche: A Power-Index Analysis, June 2009. This paper examines the structure of the Porsche SE supervisory board, which consists of three groups, following the takeover of  Volkswagen AG. The Porsche shareholders hold 6 seats, while the 324,000 Volkswagen employees and the 12,000 Porsche employees will be represented by 3 delegates each. This paper perceives each of these three groups as unitary players and presents a power-index analysis of this supervisory board. It shows that, unless the Porsche employees are made completely powerless, Porsche and VW employees will have identical power regardless of the actual distribution of seats on the employees' side. This analysis demonstrates that the request of the Volkswagen employees (for more seats than the Porsche employees in the future supervisory board) is unfounded.

8/4/09 Now freely available for download: EALE Working Paper 012-2009: Wolfgang Weigel, "Challenging Contemporary Trends in the (De-) Regulation for the Professions", April 2009.
This paper contains the warning that the intended deregulation for the professions, which is vigorously pursued by the European Union, might go too far given the nature of many services at stake. Building upon an objective function which focuses on the minimization of social cost of regulation it is argued that advocates of deregulation do not take sufficient account of the ‘credence good’ problem contained in the said services.
From the broad range of legal services the example of “authentication” for real estate, which is typically carried out by notaries is picked deliberately as an example. A sketch is provided of a comparison of ex ante and ex post regimes for the purpose of securing (risk averse) clients’ interests. Moreover, the likely consequences on the objective function are pointed out which result from the relaxation of regulations.

6/4/09 Now freely available for download: EALE Working Paper 011-2009: Bernd Hayo & Stefan Voigt, "The Relevance of Judicial Procedure for Economic Growth", March 2009. In this paper the authors challenge the view that procedural formalism undermines economic efficiency by fostering rent-seeking and corruption, arguing that a number of judicial procedures foster economic growth by increasing the predictability of court decisions, which leads to more transactions and higher investment levels. They investigate the effects on economic growth of 15 judicial procedures. Employing a standard growth model, they find in a cross-section of 67 countries that timeliness, written - as opposed to oral - procedures, and the right to counsel have a positive effect on growth, whereas the number of independent procedural actions as well as the presumption of innocence have negative effects.

24/3/09 Now freely available for download: EALE Working Paper 010-2010, Bruno Deffains & Claude Fluet, "Legal versus Normative Incentives under Judicial Error." In this paper the authors analyze the complementarity between legal incentives (the threat of being held liable for damages) and normative incentives (the fear of social disapproval or stigma) in situations where instances of misbehavior are not perfectly observable. There are high stigma-high evidentiary standard regimes versus low stigma-low standard ones. The authors argue that this may explain some of the differences between common law and civil law regarding the notions of fault or negligence. The analysis also provides an explanation for trends currently observed in civil-law systems, in particular the weakening of evidentiary requirements in tort cases.

Feld & Stefan Voigt, "Power Over Prosecutors Corrupts Politicians: Cross Country Evidence Using a New Indicator." The authors put to an empirical tests their hypothesize that prosecution agencies that are dependent on the executive have less incentives to prosecute crimes committed by government members which, in turn, increases their incentives to commit such crimes, finding that de facto independence of prosecution agencies robustly reduces corruption of officials.

regulation” is dedicated to the measure and reduction of administrative burdens for businesses. One attempt which has earned widespread attention and support is the “standard cost model” (SCM). The paper offers a brief summery of the model is as a starting point for a critical examination. It turns out that the method contains several shortcomings. It must thus be doubted that it could serve as a starting point for the typical cost-benefit-analysis which is contained in a more comprehensive regulatory impact assessment

The paper examines the intriguing question of whether courts should adjust the standard of negligence to take into account a potential asymmetry between the parties, such as where only parties who specialize in a given activity know the standard. Such an adjustment, for instance, could mean the imposition of a higher standard of care on the informed parties, compared to settings where both parties could be expected to become informed of the standard.

26/9/08 The EALE General Assembly at the 25th Annual Conference nominates new members to the EALE Management Board. The Assembly elected Professor Eli Salzberger as President, and Dr. Avishalom Tor as Secretary. The General Assembly also nominated Professor Bruno Deffains as a Management Board member for 3 years, and Professor Henrik Lando as a member for one additional year.
